Terms of Service

Please read these terms carefully before using the Exerati platform.

Last updated: January 1, 2025

1. Acceptance of Terms

By accessing or using the Exerati platform, API, CLI tools, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Exerati provides AI infrastructure services including an OpenAI-compatible API, CLI access, AI chat interface, and model testing platform. The Service allows developers and businesses to access various AI models through a unified interface. Features marked as "Beta" or "Coming Soon" may change, be delayed, or be discontinued without notice.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration and keep it up to date.

4. API Usage and Rate Limits

Your use of the API is subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary request rejection. You must not attempt to circumvent rate limits or abuse the Service. API keys are your responsibility — treat them as passwords and do not share them publicly.

5. Billing and Payments

The Service uses a wallet-based billing system. You add funds to your wallet, and usage is deducted per token based on current model pricing. Pricing is subject to change with notice. Free test credit is provided to new accounts and cannot be transferred or refunded. Wallet balances are non-refundable except where required by law.

6. Acceptable Use

You agree not to use the Service for any illegal, harmful, or abusive purposes. You must not use the Service to generate content that violates applicable laws, infringes intellectual property rights, or causes harm to others. We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

You retain ownership of content you input into the Service. Output generated by AI models through the Service is provided as-is, and you are responsible for reviewing and validating all output. The Service, including its design, code, and documentation, is the intellectual property of Exerati.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Exerati shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Termination

You may terminate your account at any time from your dashboard. We may suspend or terminate your access to the Service for violation of these terms, non-payment, or at our discretion with reasonable notice. Upon termination, your data will be retained for 30 days before permanent deletion.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
